Terms of Use for the Myspot mobile application — registration, reservations, payments, cancellation, credits, and consumer rights.

GENERAL INFORMATION

  1. Version 2.0 · Effective date: 9 July 2026 · A document of „May Spot App" OOD
  2. These Terms of Use govern the use of the Myspot mobile application by end users and apply equally to the iOS and Android versions.

1. INTRODUCTION AND ACCEPTANCE

  1. These Terms of Use (the "Terms") govern the use of the Myspot mobile application (the "Application") by natural persons who are end users ("User", "you").
  2. The Application is provided by „May Spot App" OOD, UIC 207339717, with registered seat and address of management at 5A Lale Str., fl. 4, contact email: [email protected] ("Provider", "Myspot", "we").
  3. By downloading, registering in, or using the Application, you confirm that you have read and accept these Terms and the Privacy Policy. If you do not agree with them, do not use the Application.
  4. Through the Application you reserve spots and services offered by merchant venues ("Merchants"). In the relationship between the parties, for Online Reservations Myspot acts in its own name and for the account of the relevant Merchant (commissionaire model) and is the seller with whom you enter into a legal relationship for those reservations.

2. DEFINITIONS

  1. Provider / Myspot — „May Spot App" OOD, UIC 207339717.
  2. Application — the Myspot mobile application for iOS and Android.
  3. User — a natural person who uses the Application to browse venues, make reservations, and pay.
  4. Merchant — the owner or operator of a beach venue or other business venue that offers spots and services through Myspot.
  5. Business Location — a Merchant's venue available for reservations through the Application. Spot — a specific reservable unit within the Business Location (for example, an umbrella, sunbed, or cabana).
  6. Reservation — a reservation of a Spot and/or services. Online Reservation — a reservation made by a User through the Application.
  7. Ticket — the digital voucher (an electronic reservation certificate) that Myspot issues to the User and which certifies the right to occupy the reserved Spot. The Ticket contains a QR code for registering arrival on site. The Ticket is not a fiscal document.
  8. Credits — a settlement instrument usable only within the Application. One Credit equals EUR 1.00. Credits are issued and borne by the Provider.
  9. Cancellation Policy — the rules set by the Merchant for a given Business Location, governing what portion of the amount paid is refunded upon cancellation and within what period before the reservation a cancellation carries a refund.
  10. Time of Arrival — the time by which the User must appear at the Spot in order to receive their reservation.
  11. Currency — all prices and amounts in the Application are in euro (EUR), unless expressly stated otherwise.

3. REGISTRATION, ACCOUNT, AND ELIGIBILITY

  1. To use the core features, you create an account with an email and password or via Sign in with Apple or Sign in with Google. When using Apple or Google sign-in, the terms of the respective provider also apply.
  2. You undertake to provide true, complete, and up-to-date information and to keep your account access credentials confidential. You are responsible for all actions carried out through your account.
  3. To create an account and make payments, you must be at least 18 years old and have the legal capacity to enter into contracts. If you are under 18, you may use the Application only with the consent and under the supervision of a parent or guardian.
  4. The Provider may suspend or terminate an account in the event of a breach of these Terms, fraudulent activity, or abuse.

4. RESERVATIONS AND TICKETS

  1. Reservation process. You select a Business Location, a Spot, and (where applicable) additional services, review a summary with the final price, and confirm the reservation with payment.
  2. Ticket. After a successful Online Reservation, you receive a Ticket with a QR code in the Application. You must present a valid Ticket upon arrival; the Merchant may refuse access without a valid Ticket.
  3. Time of Arrival and no-show. A Time of Arrival may be set for a reservation. If you do not appear by that time, the Merchant may complete the reservation and release the Spot. In this case no refund is due (see Section 6).
  4. Minimum consumption. Some Spots may require a minimum consumption, which is displayed before you confirm the reservation.

5. PRICES AND PAYMENT

  1. Prices. Prices are set by the Merchant and displayed in EUR, with taxes included for the consumer. The final amount due is shown before confirmation and payment.
  2. Payment processing. Payments are processed by Stripe. Apple Pay, Google Pay, Visa, and Mastercard are supported. Myspot does not store the full details of your payment card.
  3. Collection of payments. For Online Reservations, Myspot collects payment in its own name and for the account of the Merchant. For on-site payments (cash or card on site), the relationship is directly with the Merchant.
  4. Credits. Payment may be made wholly or partly with Credits, where available (see Section 7).

6. CANCELLATION AND REFUNDS

  1. Cancellation by the User (Merchant's Cancellation Policy). You may cancel a reservation through the Application. The refund is determined by the Cancellation Policy set by the relevant Merchant, who sets both the refund percentage and the period before the reservation within which a cancellation carries a refund (for example: cancellation up to 2 days before the relevant reservation day — 50% refund). The applicable policy is displayed clearly before you confirm the reservation and is applied automatically.
  2. Choice of refund method. When a refund is due to you upon your own cancellation, you may choose to receive it as Credits or as a return to the card you paid with.
  3. Cancellation by the Merchant. If the Merchant cancels your reservation, you receive a full (100%) refund to the original payment instrument, regardless of the Cancellation Policy.
  4. Completion and no-show. Where the service has been duly provided, as well as in the event of a no-show after the Time of Arrival has elapsed, the reservation is completed and no refund is due.
  5. Refund routing by payment instrument. Refunds are made according to the original payment method:
    1. payment by card → a return to the same card via Stripe;
    2. payment in cash on site → a cash return and void (storno) of the fiscal receipt by the Merchant;
    3. payment with Credits → the Credits are redeemed and are not returned back as Credits.
  6. Refunds for Online Reservations are made by Myspot in the name and for the account of the Merchant.

7. CREDITS

  1. Credits are a settlement instrument valid only within the Application; one Credit = EUR 1.00. Credits are issued and borne by the Provider.
  2. Credits may be granted to you upon cancellation of a reservation, if you have chosen this refund method and if the Merchant's Cancellation Policy provides for a refund.
  3. Credits must be used within 12 (twelve) months of being granted; after this period the right to them lapses. When available, Credits are used first for a new reservation.
  4. Credits cannot be cashed out and are not paid in money. Unredeemed or expired Credits do not give rise to any monetary claim.

8. COMPLAINTS AND CLAIMS FOR ONLINE RESERVATIONS

  1. Online Reservations. If something goes wrong during your stay in connection with an Online Reservation, you may contact us at [email protected]. Myspot reviews each claim individually (on a case-by-case basis) and, at its discretion, determines whether it is well founded. If the claim is well founded, Myspot may compensate you (for example, through a refund or Credits).
  2. This Section applies only to Online Reservations made through the Application. For on-site reservations and consumption, claims are addressed directly to the relevant Merchant, who is responsible for the on-site service.
  3. This Section does not limit your statutory rights as a consumer under applicable mandatory law.

9. RIGHT OF WITHDRAWAL (14 DAYS) AND EXCEPTIONS

  1. Reservations made through the Application constitute services related to leisure activities with a specific date or period of performance. Pursuant to Article 57 of the Bulgarian Consumer Protection Act, such services are excluded from the 14-day right of withdrawal in distance contracts.
  2. Accordingly, cancellation and refunds are governed by the Merchant's Cancellation Policy (Section 6) and not by the 14-day right of withdrawal.

10. AVAILABILITY, UPDATES, AND SUPPORTED VERSIONS

  1. We strive to provide continuous and reliable access but do not guarantee uninterrupted availability. Interruptions are possible due to maintenance, updates, or technical reasons.
  2. For security and proper functioning, the use of a current version of the Application may be required. The Provider may discontinue support for older versions.

11. INTELLECTUAL PROPERTY

  1. The Application and all associated content (software, text, graphics, logos, design, trademarks) are the property of the Provider or its licensors.
  2. You are granted a limited, non-exclusive, non-transferable licence to use the Application for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works without prior written consent.

12. LIMITATION OF LIABILITY

  1. The Application is provided on an "AS IS" and "AS AVAILABLE" basis. To the extent permitted by law, the Provider is not liable for indirect or incidental damages arising from the use of or inability to use the Application.
  2. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law, including consumers' statutory rights.
  3. The Merchant is responsible for the service provided on site (quality, safety, compliance of the items offered).

13. DATA PROTECTION

  1. The processing of your personal data is governed by Myspot's Privacy Policy, which is an integral part of these Terms and is available in the Application.

14. CHANGES TO THE TERMS

  1. The Provider may update these Terms. For material changes, we will notify you before they take effect — through the Application or by email.
  2. Continued use of the Application after the changes take effect constitutes acceptance of the updated Terms. If you do not agree, you may stop using the Application and delete your account.

15. GOVERNING LAW AND DISPUTE RESOLUTION

  1. These Terms are governed by Bulgarian law, without prejudice to the mandatory consumer protections under the law of your habitual residence.
  2. Disputes are resolved by the competent court under applicable law.
  3. You have the right to file a complaint with the Consumer Protection Commission (CPC) and to use the EU online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
